BY USING THIS PRODUCT, YOU ACKNOWLEDGE THAT WE HAVE NOT MADE ANY REPRESENTATIONS OR WARRANTIES HEREUNDER OR IN CONNECTION WITH THE DEVICE, INCLUDING BUT NOT LIMITED TO THE QUALITY OR FUNCTIONALITY OF THE ALARM OR THAT THE DEVICE WILL BE ACCESSIBLE OR OPERATIONAL ON A CONTINUOUS BASIS OR THAT SUCH OPERATION WILL NOT BE LIMITED OR INTERRUPTED FROM TIME TO TIME. WE DISCLAIM ANY SUCH REPRESENTATIONS, WARRANTIES, OR COVENANTS INCLUDING WITHOUT LIMITATION THE WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND OF NON-INFRINGEMENT.

Violation of any provision of this agreement requires that you cease all use of the device and its related documentation immediately. You further agree to pay all attorneys' fees, costs, and settlement costs arising from any action, violation, or enforcement of this agreement in any form.
Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitations may not apply to you. In cases where the above limitations do not apply by law, the manufacturer's liability to you for actual damages for any cause whatsoever, and regardless of the form of the action, will be limited to the greater of U.S. $1.00. This warranty shall be void if the device has been tampered with, modified, improperly used, or used in a manner inconsistent with its design.
Term
This agreement is effective until terminated. You may terminate it by ceasing all use of the device and destroying related documentation. The manufacturer reserves the right to change the terms of this agreement at any time without notice.
Severability
If any provision of this agreement shall be held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision is invalid but that by limiting such provision it would become valid, then such provision shall be deemed to be written and enforced as so limited.
Waiver of Contractual Right
The failure of the manufacturer to enforce any provision of this agreement shall not be construed as a waiver of the right to subsequently enforce strict compliance with every provision herein.

This agreement shall be governed by the laws of the United States of America.

The Red Fern Rising Water Alarm is a mechanical early-warning device. By using this product, you acknowledge and agree to the following:
- Installation: Users must securely stake the dual steel ground-rod system into the substrate at the chosen location. Failure to ensure a secure, stable installation in the soil substrate may result in false readings or device failure.
- Limitations: This device is a mechanical tool intended to supplement, not replace, active monitoring of water levels. It is designed for backcountry conditions but is subject to physical limitations based on extreme environmental debris or severe, rapid terrain alterations. Its is just a tool in the chest not a fail safe solution.
- Calibration: Users must verify proper mechanical functionality prior to every deployment.
- Assumption of Risk: You acknowledge that camping in flash flood zones involves inherent risks, including death. You voluntarily assume all risks associated with your campsite selection and agree that Red Fern LLC shall not be held liable for any damages resulting from environmental conditions. Never camp in a flash flood zone when there is any chance of floods.
Maintenance and Care Protocol
To maintain the integrity of the mechanical trigger system, users are responsible for the following:
- Inspect the dual steel ground-rod system for structural integrity before each use.
- Clear any accumulated debris from the sensing mechanism after exposure to water.
- Store the device in a dry, temperate environment when not in use to prevent corrosion or mechanical fatigue and keep the battery charged.
